Acknowledgement:
The participant and/or their parent(s) or guardian(s) understand that participating in any activity while on the premises owned or operated by SonFlower Ranch LLC (hereinafter “premises”) IS AN INHERENTLY DANGEROUS ACTIVITY. The animals present on the premises (including farm, wild, or domestic) may interact with participant, may urinate, defecate, sneeze or otherwise engage in behavior consistent with being the aforementioned animals, and some participants may be allergic to them. Additionally, some communicable diseases can be passed from the animals to humans, including but not limited to diseases from the rabies vector species present on the premises. Further, because of the nature of the premises, there are inherent risks associated with the process of ranching/animal care including but not limited to exposure to moving vehicles and heavy equipment, potential contact with metal fencing, and uneven, unpaved ground. The participant and/or his/her parent(s) or guardian(s) ASSUME ALL LEGAL LIABILITY for any risk of injury, property damage, or death while participating in activities provided by and/or conducted on the premises owned or operated by SonFlower Ranch LLC including but not limited to touring the premises, viewing and/or interacting with animals and all activities connected therewith, attending dinners/festivals or other events on the premises whether for fundraising or other purposes.
Participant and/or their parent(s) or guardian(s) understands, acknowledges, and agrees to abide by all rules and regulations, stated by SonFlower Ranch LLC’s representatives at any time while on premises. Participant acknowledges failure to follow these instructions or the rules and regulations may result in an immediate cancellation of any event and/or banishment from the premises with no reimbursement of monies paid, including but not limited to ticketed sales, down payments or other remuneration made to SonFlower Ranch LLC.
Participant and/or their parent(s) or guardian(s) authorizes SonFlower Ranch LLC ( to use any photographs, videotapes, recordings or any other copyrightable material taken while on participating in the attractions on the premises for publicity, advertising, or any other legitimate purpose.
Waiver and Release:
Participant and/or their parent(s) or guardian(s) hereby waives, releases, and discharges SonFlower Ranch LLC (including owners, officials, directors, officers, representatives, employees (if any) contractors, vendors, sponsors, and other agents, hereinafter collectively known as the “Releasees”) from any and all liability, claims, demands or actions or causes of action whatsoever arising out of any damage loss or injury, including but not limited to, or resulting from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft or damage, communicable disease or any loss, demand, claim or cause of action of any kind which occur, or may occur, as a result of participant's use of, or participation in any SonFlower Ranch LLC activities, attractions, events and/or being present on the premises in any way. Each participant EXPRESSLY ASSUMES SUCH RISK AND WAIVES ANY CLAIM HE/SHE MIGHT STATE AGAINST THE RELEASEES. Participant and/or their parent(s) or guardian(s) further agree to HOLD HARMLESS and INDEMNITY RELEASEES against any losses, liabilities and claims arising out of participant's use of, or participation in any SonFlower Ranch Wildlife Rehabilitation Center and/or SonFlower Ranch LLC activities, attractions, events and/or being present on the premises in any way.
Certification:
I hereby certify I am VOLUNTARILY AND KNOWINGLY agreeing to this Release, Assumption of Risk and Waiver of Liability Agreement as a condition precedent to participating in any SonFlower Ranch LLC activities, attractions, events and/or being present on the premises for any reason. I understand that I would not be allowed to participate in any activities, attractions, or events, whether sponsored by SonFlower Ranch LLC or not, or to be on the premises if this Release, Assumption of Risk and Waiver of Liability Agreement is not signed by me. I further state that I have been FULLY INFORMED of the potential risks with the activities in which I could be involved while on the premises, and wish to proceed with signing this Release.
By arriving on premises, I agree to this Release, Assumption of Risk and Waiver of Liability
